           The RMSEF document, as developed by the Research and Special Programs Administration agency, helps you construct and then implement your plan in the following three steps.

      &lt;br/&gt;&#xD;

    &lt;span&gt;&#xD;
      
           You are required, as a HAZMAT hauler, to always have an HM Security Plan for as long as you are handling HAZMAT hauls. It should always be in writing. The security plan is meant to educate your employees responsible for handling the HAZMAT hauls. This is subject to their security clearance or any background investigations, and whether they are on a need-to-know basis.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Copies of the security plan have to be available to the people responsible for developing and implementing them. The copies should be accessible at their workstations and electronically. Those documents should also be available to the official Department of Transport and Department of Homeland Security personnel upon request.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           It is upon you as a company to revise or update the security plan annually. Every time you make an amendment or revision to the document, you should furnish the responsible employees with an updated copy of your HM Security Plan.

  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;

          &#xD;

           Setting a security plan in place is just one part of ensuring it works. The other part is to actually verify that, should anything happen, the security plan you have put in place will hold up, or even defeat the threat.

           Put simply, a DOT roadside inspection is a series of examinations that ascertains if Commercial Motor Vehicles (CMVs) are in good shape to operate. This happens when a Motor Carrier Safety Assistance Program (MCSAP) inspector examines individual commercial motor vehicles and drivers to determine if they comply with the Federal Motor Carrier Safety Regulations (FMCSRs) and Hazardous Materials Regulations (HMRs.)
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Failure of compliance may lead to revocation or withdrawal of the operational license. But upon compliance, you will be allowed to resume your operations. Remember that a traffic enforcement violation may also be recorded in conjunction with a roadside inspection.

            Under the North American Standard, there are eight different levels of a DOT Roadside Inspection. And according to the

           Commercial Vehicle Safety Alliance
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            (CVSA), there are about four million inspections conducted across North America every year.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Unfortunately, you may not even know which of the eight different levels will be conducted until you're stopped by the inspectors. Consequently, it is vital to understand each of these eight levels of DOT inspections and help your drivers become compliant.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;

            Considered the most comprehensive and common DOT Roadside Inspection, the Level-1 North American Standard Inspection covers a series of tests on the driver and the vehicle. Talking of how common it is, in 2019,

    &lt;/span&gt;&#xD;
    &lt;a href="https://www.cvsa.org/news-entry/2019-roadcheck-results/" target="_blank"&gt;&#xD;
      
           45568 inspections out of 67072 were considered as Level-1 inspections
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            by CVSA. With these numbers, it wouldn't be fair not to consider this as your most regular inspection.
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           All the same, it examines the driver's Commercial Driver License (CDL), seat belt, drug and alcohol intake, medical examiner's certificate, Skill Performance Evaluation (SPE) certificate (if applicable), the record of duty status (RODS), and hours of service compliance.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In regards to the vehicle, it can examine several factors, including but not limited to; brake systems, electrical systems, coupling devices, lighting devices, steering system, fuel and exhaust system, emergency exit, windshield wipers, rims, hubs, wheels, and the overall open body. HM/DG requirements may also apply. In other words, level-1 inspection is mostly concerned with driver and vehicle safety.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Level 2: Walk-Around
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;h3&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Generally, this inspection level is very similar to the level-1 DOT inspection. However, the one distinction existing is that level 2 will only examine those items that can be inspected without having to physically get below the vehicle. That even explains why it's referred to as the walk-around vehicle/driver inspection.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           While it can be less rigorous than the former, level 2 inspections still call for the driver to prepare as much as possible since it encompasses nearly every item in level-1, such as drug and alcohol screening, among other vehicle and driver-related items.

           As the name suggests, level 3 driver-only inspection will examine the credentials specific only to the truck driver when applicable. Not to mention, traffic violations will also be included in a level 3 inspection, if applicable.

    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Level 4 DOT inspections are special examinations for a one-time investigation of a certain vehicle or driver-related concerns. It may be done to verify the truth about a particular norm or trend. For instance, the fuel or exhaust system may be examined for safety purposes or air pollution concerns. Alternatively, it may even entail the verification of a common violation trend among the CMV operators and carriers.

  &lt;p&gt;&#xD;

           Level 5 DOT inspection, often referred to as vehicle-only inspection, conducts an inspection of the vehicle-related items stated under level-1 North American Standard inspection. The only difference is that it is conducted in the absence of the truck driver. It may also be done at any location, including a company-owned facility akin to the DOT audit.

           Level 6 DOT inspection is dedicated to Transuranics and Highway Route Controlled Quantity substances. In other words, it is largely concerned with radioactive shipments or rather radioactive cargo. The NAS inspection specific to radiological shipments are subject to;

  &lt;/p&gt;&#xD;
  &lt;ol&gt;&#xD;
    &lt;li&gt;&#xD;
      &lt;span&gt;&#xD;
        
            Enhancement to the level 1 DOT inspection

            Requirements pertaining to radiological materials, that is, before and after shipment

      &lt;span&gt;&#xD;
        
            One of those rules is the

           , for certain cases, transporters and shippers of hazardous materials are required to create a security plan. The purpose of the plan is to outline how the company is going to prevent their equipment, or the hazardous cargo they carry, from being employed in a terrorist act as a weapon.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Who Are These Rules For?
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;h2&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/h2&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           As you begin to haul HAZMAT loads, some other sections of the law begin to apply to you. However, it is not all the HAZMAT rules that will apply in your specific case, unless you meet the threshold set in law.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           In the case of a security plan, if you have a DOT number and are a registered HAZMAT hauler, you should pay attention to this requirement. As you increase your hauling capabilities and the products you haul, then these rules begin to come into play.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Generally, you need to develop and implement a security plan if your company transports the following types of Hazmat loads in large bulk quantities (3,000 Kg for solids and an equivalent amount in liters for liquids and gases).
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Division 2.1 material
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Division 2.2 material with a subsidiary hazard of 5.1
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Class 3 material meeting requirements for packing group I or II
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Division 4.2 material meeting requirements for packing group I or II
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Class 8 material meeting requirements for Packing Group I
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           You will also need a security plan if your company transports any quantities of the following materials;
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;br/&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Division 1.1, 1.2 and 1.3
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Division 1.4, 1.5, or 1.6 that require placarding according to Subpart F of Part 172 of HMR
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Material poisonous when inhaled as described in §171.8
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Desensitized explosives meeting description of Division 4.1 or Class 3 material that requires placarding according to Subpart F of Part 172 of HMR
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Organic peroxide of any quantity, whether liquid, solid, or temperature-controlled.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     Selected agents and toxins controlled by the Center for Disease Control or the US Department of Agriculture.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           ●     IAEA Code of Conduct Category 1 and 2 materials.
          &#xD;

  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           These are most of the HAZMAT materials that will mean your company has proposed a security plan.

           Exceptions in the Regulations
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h3&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Your knowledge of the exceptions or the documentation will be required during an audit, inspection, or investigation. You should be able to cite the exact exception you are trying to use on the Electronic Logging Device or paper log. Here's a quick look at some of the exceptions. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           1. Adverse Driving Conditions
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           It's not always guaranteed that you will be driving under clear skies or even slightly overcast conditions. Your work as a trucker may see you set off with the sun and a warm breeze bidding you goodbye. But treacherous disruptions in the form of snowstorms and heavy rain forming may welcome you with open arms. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           The Hours of Service regulations mandate a 14-hour workday limit and an 11-hour driving limit. When faced with adverse driving conditions that cause you to miss a rest stop or prevent you from stopping, you are allowed to extend both the 14-hour workday limit and the 11-hour driving limit by up to two hours. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           2. Short-Haul Exception
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           As a driver, you know that the company you work for is expected to record your duty status to keep tabs on the hours you work in a day and in a week. However, if you are only covering short-haul routes, you will be exempt from this rule. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Ensure that you're operating within the 150 air-mile radius set by the regulations. You also have to return to the location you report to when starting your shift. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Also, drivers are expected to take a 30-minute break when at least 8 hours have elapsed since they came on duty. As a short-haul driver, this rule will not apply if you are within a 150-mile radius of your reporting location while driving vehicles that don't require a commercial driving license. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           3. 16 -hour Exception
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           This exception only applies to drivers who are on a one-day work schedule. You can stretch the official time on duty to 16 hours, but the driving time still remains 11 hours. 
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Note that you cannot use this exception in conjunction with the adverse weather exception. And a driver may not apply it again until after they have taken a 34-hour break.
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;h4&gt;&#xD;
    &lt;span&gt;&#xD;
      
           4. Industry-Specific Exceptions
          &#xD;
    &lt;/span&gt;&#xD;
  &lt;/h4&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            The industry you work in may have a few Hours of Service exceptions that set them apart from other industries. For example, Title 49 CFR 395.1 (k)

           grants exemptions
          &#xD;
    &lt;/a&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;span&gt;&#xD;
        
            to drivers in agriculture during the planting and harvesting seasons, as well as transportation of agricultural commodities such as fish, livestock, bees, and others. 
           &#xD;
      &lt;/span&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      &lt;br/&gt;&#xD;
    &lt;/span&gt;&#xD;
  &lt;/p&gt;&#xD;
  &lt;p&gt;&#xD;
    &lt;span&gt;&#xD;
      
           Other industries that may have specific exceptions include oil &amp;amp; gas, emergency services, as well as utility services. Below is a more complete list of exception categories that you may need to review:

Whenever you are traveling on public roads, the US DOT has occupational safety jurisdiction. This is through the Federal Motor Carrier Safety Administration. There is a
